Disclosure of personal data requires an applicable legal basis. Depending on the processing, this may involve consent, contractual necessity, a legal obligation or legitimate interests, together with applicable confidentiality requirements. Storage of information on, or access to information already stored on, a user’s device generally requires prior informed consent under § 25 TDDDG unless a statutory exception applies, such as strict necessity for a service expressly requested by the user. Any subsequent personal-data processing also requires an appropriate GDPR legal basis. Browser settings alone do not replace a required consent mechanism.

VII. Data Processing through Tracking-Measures – Horak Attorneys at Law

Analytics and advertising measures must be assessed separately from strictly necessary website functions. Required consent must be obtained before non-essential tracking is activated and must be capable of withdrawal. The actual services, purposes, providers, retention periods and transfer arrangements must be identified before this draft can describe the deployed website.

a.) Google Analytics

Google Analytics: before publication, confirm whether this service is actually used and, if so, its version, provider, consent setup, data categories, retention settings and international-transfer safeguards. The former description of Google Inc. and a fixed US storage arrangement must not be treated as a verified description of the current site.

  • browser type / version
  • used operating system
  • referrer URL (the previously visited page)
  • host name of the accessing computer (IP address)
  • time of server request

Any transmission to a Google service must be described using the actual configuration and applicable contractual and transfer safeguards. The following data-category list is an inventory to verify, not confirmation that all listed data are currently transmitted.

Pseudonymisation or IP-address processing does not by itself guarantee anonymity or exclude personal-data processing. A browser add-on may provide an additional control but does not replace prior consent where consent is legally required.

b) Google Conversion Tracking

Google Ads conversion tracking: confirm whether conversion measurement is enabled, which tags or cookies are used, their duration, recipients and the applicable consent settings. Tracking may not be activated merely because an opt-out is offered. A previous provider-domain reference is retained below for technical review. www.googleadservices.com
